Licence and usage terms for digital 3D-print files

These licence and usage terms supplement the General Terms and Conditions of 3DOrder and apply to all digital 3D-print files offered as a “Digital private licence” or “Digital commercial licence”.

2. Subject matter

The purchase does not transfer ownership of the 3D file. It grants a simple, non-exclusive and non-transferable right to use the purchased model. All copyright and other intellectual-property rights in the file remain with 3DOrder or the respective rights holder.

The licence applies solely to the purchasing person or the company identified in the purchase. Sublicensing or transferring the licence is prohibited.

3. Digital private licence

  • The file and prints made from it may be used only for the purchaser’s own private, non-commercial purposes.
  • Private prints are unlimited in time and quantity.
  • Technical modifications are permitted only where the result remains exclusively for private use and the designer identification is retained.
  • Selling, paid distribution, commercial display, commissioned production for third parties and any other commercial use are prohibited.

4. Digital commercial licence

  • The purchasing business may manufacture, advertise, offer and sell physical prints of the model.
  • The commercial licence is perpetual and has no quantity limit; no subscription is required.
  • Use is restricted to the purchasing business. Necessary internal access by employees remains the licensee’s responsibility.
  • Providing the file to external manufacturing partners or other third parties requires prior written approval from 3DOrder.

5. Restrictions applying to both licences

  • The original file and any modified, converted or derivative file may not be sold, gifted, exchanged, rented, published, uploaded or otherwise made available to third parties.
  • The file may not be offered as part of a digital collection, download, platform library or sublicence.
  • Any 3DOrder base mark or designer identification contained in the model may not be removed, altered, obscured or made illegible in the file or on a print.
  • Purchasing a licence does not grant rights to third-party trademarks, logos, characters or other protected subject matter.

6. Customer-supplied content

For models made to a customer specification, the licence covers only the 3D file created by 3DOrder. No rights to customer-supplied trademarks, logos, characters, images or other source materials are transferred. The customer is responsible for holding all rights required for the intended use.

7. Licence prices and discounts

  • The private-licence price is 10% of the regular, undiscounted selling price of the physical product.
  • The commercial-licence price is 500%, or five times, that regular selling price.
  • Promotional prices and discounts on the physical product do not reduce the licence price. The price displayed for the selected licence variant in the shop is binding.

8. Delivery and technical requirements

Digital licences do not include a physical product and do not incur shipping charges. Following successful payment, the file is supplied by download or to the email address entered with the order. File format, dimensions and recommended print settings are stated in the relevant product description or accompanying file information.

The licensee is responsible for suitable hardware and software, slicer settings, material selection and printing conditions. Statutory conformity and warranty rights remain unaffected.

9. Right of withdrawal for digital content

Consumers generally have a statutory right of withdrawal for digital content. Where the consumer expressly requests that 3DOrder begin supplying the digital content before the withdrawal period ends and acknowledges that this causes the right of withdrawal to be lost, that right ends when supply begins, subject to the applicable statutory requirements.

For an order containing a digital licence, the required express request and acknowledgement are collected in the cart before checkout and stored as order information.

10. Licence breaches

A material breach of these terms may result in termination of the right to use the file. Unauthorised publication, disclosure or sale of the file may result in immediate termination. Statutory claims, including injunctive relief and damages, remain unaffected.

11. Final provisions

Austrian law applies. Mandatory consumer-protection rules and statutory places of jurisdiction remain unaffected. Changes to these terms do not apply retroactively to licences already purchased.
